Should parents have the right to be informed of a life or death surgery for a minor child?

ALERT: It's well-understood that society can require parental notification or consent when minors get their ears pierced. They can't have their tonsils removed without it, either. But what about a much more radical procedure -- like abortion?

Over 30 states have enacted parental notification or parental consent laws. However, these laws are often circumvented by minors traveling or being transported to other states that do not have parental notification requirements, often under pressure from older boyfriends or at the urging of abortion providers. In order to protect the welfare of minor girls and the rights of parents, Congress has a duty to regulate this interstate activity.

With this in mind, Rep. Ileana Ros-Lehtinen (R-FL) has introduced H.R. 748, the Child Interstate Abortion Notification Act (CIANA), with the bi-partisan support of 108 original cosponsors.

This critical legislation makes it a Federal offense to transport a minor across state lines to circumvent that state's abortion parental notification laws.

In addition, the bill will require that in a state without a parental notification requirement, abortion providers are required to notify a parent.

About 80% of the public favors parental notification laws, and over 30 states have enacted such laws. Yet, these laws are often evaded by interstate transportation of minors, often openly encouraged in advertising by abortion providers.

Said Ros-Lehtinen, "A minor who is forbidden to drink alcohol, to stay out past a certain hour, or to get her ears pierced, is certainly not prepared to make a life-altering, hazardous and potentially fatal decision, such as abortion, without the consultation or consent of at least one parent."

"My legislation will close a loophole that allows adults not only to help minors break state laws by obtaining an abortion without parental consent, but also contributes to ending the life of an innocent child," said Ros-Lehtinen. "I am hopeful that in this 109th Session of Congress, we will be successful in securing the rights of parents once and for all."

Let's make SURE this bill finally DOES pass!

TAKE ACTION: The CIANA requires any abortionist to notify a parent before performing an abortion on a minor who is a resident of another state, unless the minor has already received authorization from a court in her home state, or unless the abortionist is already required to provide such parental notification by a current law in the state in which he practices. If the minor asserts that she is the victim of abuse, the abortionist would notify the appropriate state child abuse agency instead of a parent.

H.R. 748 also incorporates the provisions of the "Child Custody Protection Act," a bill originally proposed in 1998, under which it would be a federal offense to transport a minor across state lines for an abortion without fulfilling the requirements of a parental notification law in effect in the home state. NOTE: H.R. 748 would curb much of the currently widespread interstate circumvention of current state laws, thereby protecting the rights of parents and the interests of vulnerable minors. This is NOT a federal parental involvement law; it merely ensures that these state laws are not evaded through interstate activity.
